Description
Beginning December 1, 2025, settlement agents will be required to report certain residential real estate transaction information to the Financial Crimes Enforcement Network (FinCEN). This rule applies when the buyer is an entity (corporation, LLC, trust, etc.) and there is no lender involved with an anti-money laundering program.
To remain compliant, settlement agents will be requesting detailed information from both buyers and sellers. This may include:
Reporting person information and closing date
Property address and full legal description
Buyer/transferee information
Individuals associated with the buyer/transferee (authorized signers and beneficial owners)
Seller/transferor information (including trustee details if the seller is a trust)
Purchase price and payment details, including bank account information for fund sourcing
Any third-party payment information on behalf of the buyer/transferee
