Listing Policies are strictly enforced at CBOR MLS. Please ensure you stay up-to-date on current Listing Policy to best support your brokerage agents as they take on listings.

 

CBOR MLS Listing Entry Rules

Before we delve into NAR's Clear Cooperation Policy, let's address CBOR's MLS Listing Entry Rules:

  • New Listings
    • All Exclusive Right to Sell and Exclusive Agency listings must be entered in the MLS system within 1 Business Day of the Listing Agreement Effective Date.

  • Pending Status
    • A property placed Under Contract (Pending) or Active with a Contingency (contingent upon the sale of another property) must be entered in the MLS system within 1 Business Day of the Under Contract date.

  • Closed Status
    • A property placed in a Closed (Sold) status must be entered in the MLS system within 5 Business Days of Date of Closing.

  • Misc. Listing Changes
    • Listing Changes: Change of Status requiring a Seller signature must also be entered within 1 Business Day of the Effective Date of the Change of Status. (Cancelling Listing/Withdrawing Listing)
 

What is the NAR Clear Cooperation Policy?

NAR Clear Cooperation Policy 8.0 states:

Within one (1) business day* of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public facing websites, brokerage website displays (including IDX and VOW), digital communications marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public. (Adopted 11/19)

 

*Business days exclude Saturdays, Sundays, and holidays.

“Holidays” include all recognized federal & state holidays.

Waived Listings & Clear Cooperation
When waiving a listing from CBOR MLS, you are required to email liz@cbormls.com a copy of the Listing Agreement & MSC-116 (Listing Submission Waiver) to avoid any penalty fines.

Items to Note:

For those Sellers who request their listing be waived, we suggest providing them with the following information to express just how limited an MLS Subscriber is able to properly market a listing while kept off-MLS:

 

Something to Consider:

If your Seller does not want to receive the FULL exposure of the MLS but you want to provide a solution that does not limit your ability to market and sell the property outside of the Listing Brokerage, consider Select the Seller Opt Out option and deselect the Broker Distribution options in the MLS upon adding the Listing (with Seller consent).

 

Doing this will limit the visibility of the listing outside the MLS, but will still allow you to cooperate with other Subscribers of the CBOR MLS:
